K-Nine Pros — Acceptable Use Policy

This Acceptable Use Policy (this “Policy”) governs use of the K-Nine Pros platform at kninepros.com (the “Platform”). It is incorporated by reference into the Terms of Service (Document A-001) and into each subscription, evaluation, and service agreement with K-Nine Pros LLC (“K-Nine Pros”). A violation of this Policy is a material breach of those agreements.

This Policy applies to every User of the Platform, including trainers, the staff members trainers authorize, dog owners, evaluators, contributors, and community participants. If you authorize staff or others to use the Platform under your account, you are responsible for their compliance with this Policy, and you will ensure that each authorized user agrees to comply with this Policy before accessing the Platform.

1. Definitions

“Authorized User” means an individual a Customer permits to access the Platform under the Customer’s account.

“Customer” means a party that has entered into an agreement with K-Nine Pros for use of the Platform, including a trainer, and each Authorized User the Customer permits to access the Platform.

“Messaging Features” means the Platform features that send email, text (SMS/MMS), or other messages to a Customer’s clients or leads, including the Automation Engine, and including features that operate through a Customer’s connected third-party messaging accounts.

“Platform” means the K-Nine Pros software-as-a-service application at kninepros.com and its subdomains, including all modules, features, AI Agents, the Community, and the Directory.

“User” means any person who accesses or uses the Platform.

2. Prohibited Conduct (General)

You will not, and will not permit any Authorized User or other person to, use the Platform to:

Violate any applicable law or regulation, or any third party’s rights, or engage in any unlawful, fraudulent, deceptive, or harmful activity.

Infringe or misappropriate any patent, copyright, trademark, trade secret, or other intellectual property or proprietary right.

Upload, post, store, or transmit content that is unlawful, defamatory, obscene, harassing, threatening, abusive, hateful, or discriminatory, or that promotes violence or harm.

Upload, post, store, or transmit any child sexual abuse material, any content that sexually exploits or endangers a minor, or any non-consensual intimate imagery, including synthetic or manipulated media (deepfakes). K-Nine Pros reports child sexual abuse material to the appropriate authorities.

Harass, bully, threaten, stalk, or intimidate any person, or incite others to do so.

Upload or transmit any virus, malware, or other harmful code, or attempt to gain unauthorized access to, probe, scan, or test the vulnerability of the Platform or any related system, or breach or circumvent any security or authentication measure.

Reverse engineer, decompile, disassemble, scrape, or use any automated means to access or extract data from the Platform beyond what the documentation expressly permits, or attempt to derive source code or underlying models.

Copy, resell, sublicense, rent, lease, or otherwise make the Platform available to any third party except as expressly permitted by your agreement.

Interfere with or disrupt the integrity or performance of the Platform, impose an unreasonable or disproportionately large load on the Platform’s infrastructure, or attempt to deny service to any user.

Share login credentials, allow access by anyone other than a permitted Authorized User, or exceed the number of Authorized Users included with your subscription.

Misrepresent your identity or affiliation, impersonate any person or entity, or falsely state or misrepresent your credentials, certifications, qualifications, or training methods.

Collect, store, or process personal information unlawfully, or handle categories of sensitive data the Platform is not designed to handle, including protected health information under HIPAA, the personal information of children under 13, or data subject to export-control regulations (ITAR).

This Policy is at least as restrictive as the acceptable use policy of K-Nine Pros’s hosting provider. Your use of the Platform must also comply with that hosting provider’s acceptable use policy.

3. Messaging Compliance (Email and Text)

If you use the Messaging Features, this Section applies to you in full. The Messaging Features send messages through third-party providers (such as Twilio, CallRail, and SendGrid). You are the sender of those messages and are solely responsible for their content, recipients, timing, and lawfulness. Violations can cause your messages — and, where you share a registration with others, other users’ messages — to be blocked, and can result in carrier penalties.

3.1 Compliance with law. You are solely responsible for complying with all laws applicable to your communications, including the Telephone Consumer Protection Act (TCPA), the CAN-SPAM Act, state telemarketing and consumer-protection laws, and the rules of the carriers and messaging providers through which your messages are sent.

3.2 Registration. Before sending text messages through the Platform, you must complete and maintain any required messaging registration, including A2P 10DLC brand and campaign registration (or toll-free verification), with accurate and current registration information. You may not send messages until your required registration is complete and active.

3.3 Consent. You must obtain and keep records of prior express consent from each recipient before sending messages, and prior express written consent before sending marketing messages. Consent must be given by the recipient directly to you for the specific type of message you send. You may not send messages to recipients whose consent was purchased, rented, sold, shared, or assumed, and you may not use purchased or rented contact lists.

3.4 Opt-out. You must honor opt-out and “STOP” requests promptly and, in any event, within the time required by law (currently within ten (10) business days), and must stop sending messages to a recipient who has opted out, other than a single confirmation of the opt-out. You must include clear opt-out instructions in your messages.

3.5 Identification and content. Your messages must clearly identify you as the sender. Email must include a valid physical mailing address, accurate header and subject information, a functioning unsubscribe mechanism, and a link to your privacy policy. You must disclose message frequency and that message and data rates may apply where required.

3.6 Prohibited message content. You will not send messages that contain or promote: content in the categories commonly restricted by carriers as “SHAFT” (sex, hate, alcohol, firearms, tobacco); cannabis or CBD products; prescription medications that cannot be sold over the counter; illegal, fraudulent, phishing, or deceptive content; content designed to evade carrier filtering (such as intentionally misspelled words or non-standard opt-out language); or public URL shorteners. You will not spoof or falsify sender identification, and you will not use the Messaging Features for emergency or life-safety-dependent communications.

3.7 Quiet hours. You will send messages only during the hours permitted by law (generally 8:00 a.m. to 9:00 p.m. in the recipient’s local time), and earlier or later only where additionally restricted by applicable state law.

3.8 Your privacy policy. You must maintain your own privacy policy that discloses your collection and use of phone numbers and email addresses, and that states that you do not share mobile information with third parties for their marketing purposes.

3.9 Shared-registration risk. You acknowledge that where the Messaging Features operate through a shared messaging registration, your violation of this Section may cause messages of other users on that registration to be filtered or blocked. K-Nine Pros may suspend your access to the Messaging Features immediately to protect the Platform and other users.

4. AI Features

4.1 Advisory only; human review. The Platform’s AI Agents are powered in part by a third-party AI provider. AI output is advisory only. Where you use AI output to provide advice, a recommendation, or a decision that affects a person (including a dog owner), a qualified person — you, the professional — must review the output before it is used or disseminated. You are responsible for the accuracy and appropriateness of anything you provide to your clients.

4.2 AI disclosure. Where you present AI-generated output directly to a dog owner or other individual, you must disclose that you are using AI to help produce the advice, recommendation, or content, at least at the beginning of each session. Any consumer-facing chatbot or interactive AI feature must disclose that the individual is interacting with AI rather than a human.

4.3 No impersonation. You will not present AI-generated output as human-generated, or use AI output to convince a person that they are communicating with a human when they are not.

4.4 No professional advice through AI. You will not use the AI Agents to generate veterinary, medical, legal, or financial advice presented as professional advice. AI output is not a substitute for a licensed veterinarian, and no veterinarian-client-patient relationship is created through the Platform or its AI Agents.

4.5 No misuse. You will not attempt to jailbreak, prompt-inject, or circumvent the safety measures of the AI Agents, and you will not attempt to extract, scrape, copy, or distill the underlying AI models. You will not use the AI Agents to generate content prohibited by this Policy or by the AI provider’s usage policy, including animal-cruelty content, hateful content, harassing content, or unlawful, deceptive, or harmful content.

4.6 AI provider terms. Your use of the AI Agents must comply with the AI provider’s usage policy. K-Nine Pros may suspend access to the AI Agents for violations and may be required to cooperate with the AI provider’s compliance processes.

5. Pet-Industry and Professional Conduct

5.1 No animal cruelty. You will not use the Platform to engage in, arrange, depict, promote, or facilitate animal cruelty, abuse, or neglect, or to share content that does so.

5.2 No veterinary advice. You will not use the Platform to provide veterinary diagnosis or treatment, or to present any information as veterinary advice. The Platform does not provide veterinary services and does not create a veterinarian-client-patient relationship. Direct medical questions about an animal to a licensed veterinarian.

5.3 Accurate credentials. You will accurately represent your credentials, certifications, qualifications, experience, and training methods on your profile, in the Directory, and in communications with clients. You will not misrepresent or overstate any credential or certification.

5.4 No outcome guarantees. You will not represent that K-Nine Pros guarantees any training outcome. Training results depend on many factors outside K-Nine Pros’s control, and animal behavior remains the responsibility of the animal’s owner and the engaged professional.

5.5 Media and consent. You warrant that you have the rights and consents necessary to upload any photo, video, or other media you submit, and that such media does not depict illegal activity or animal abuse.

5.6 Your own compliance. You are responsible for your own licensing, insurance, permits, and compliance with the animal-care, boarding, consumer-protection, tax, and other laws applicable to your business. K-Nine Pros provides software only and is not responsible for your professional services or your legal compliance.

5.7 Honest evaluations. Where you record an evaluation or behavior profile, including for an animal with a history of aggression or of causing injury, you will record information honestly and will not misrepresent an animal’s history in a way that creates a risk to any person or animal.

6. Reporting, Enforcement, and Changes

6.1 Reporting. Report suspected violations of this Policy through the Platform’s in-application support system.

6.2 Investigation. K-Nine Pros may investigate suspected violations and may review, restrict, or remove content that violates this Policy. K-Nine Pros may cooperate with law enforcement and with its providers’ compliance processes, and may report unlawful content as required by law.

6.3 Graduated enforcement. For a non-urgent violation that is capable of cure, K-Nine Pros will, where practical, give you notice and a reasonable opportunity to cure before suspending your entire account. For a violation that presents a security risk, a messaging-carrier or provider risk, an animal-safety or human-safety risk, unlawful conduct, or a risk of harm to the Platform or others, K-Nine Pros may suspend or restrict access immediately and without prior notice. K-Nine Pros may suspend an individual Authorized User or an entire account, and may terminate the applicable agreement for a material or repeated violation.

6.4 No waiver. K-Nine Pros’s decision not to enforce a provision of this Policy in one instance does not waive its right to enforce it later. Enforcement of this Policy is a right of K-Nine Pros, not an obligation, and K-Nine Pros does not assume a duty to monitor the Platform.

6.5 Changes. K-Nine Pros may update this Policy from time to time. K-Nine Pros will make the current version available and will provide notice of material changes. Your continued use of the Platform after a change takes effect constitutes acceptance of the updated Policy.
